Abstract

This Note chronicles the development of putative fathers' rights in the law, as recognized in recent Supreme Court cases and synthesizes those varied holdings into the Supreme Court's current and probable future position. It analyzes how these holdings have been applied in recent state court decisions and discusses the development of Nebraska's statutory law and case law on this topic. This Note also analyzes how Nebraska's law conforms with or violates the standards set by the Supreme Court and other state courts. Finally, it recommends changes that should be made to Nebraska law as a means of recognizing the further development of fathers' rights while at the same time maintaining the state's interests in the adoption process.
